He shows the fatal flaw in the older liberalism; trying to limit the state by means of the state. Democracy is no solution but part of the problem, and democracy extends rather than limits state power. Constitutions cannot work, because the state relies on its own courts to limit itself, but they inevitably expand state power. Only anarcho-capitalism, along the lines laid out by Murray Rothbard and Hans-Hermann Hoppe, can protect rights consistently.
