Splitting California into 3 Pieces Is Long Overdue

It now looks like California voters will have the chance to vote on whether or not the state ought to be split up into three pieces. The Los AngelesTimes reports : If a majority of voters who cast ballots agree, a long and contentious process would begin for three separate states to take the place of California, with one primarily centered around Los Angeles and the other two divvying up the counties to the north and south. This latest move is just one of many efforts over many decades to split California up, and make its constituent parts more responsive to the people who live there....

How Many Libertarians Are There? The Answer Depends on the Method You Use

There has been debate this week about how many libertarians there are. The answer is: it depends on how you measure it and how you define libertarian. The overwhelming body of literature, however, using a variety of different methods and different definitions, suggests that libertarians comprise about 10-20% of the population, but may range from 7-22%. Furthermore, if one imposes the same level of ideological consistency on liberals, conservatives, and communitarians/populists that many do on libertarians, these groups too comprise similar shares of the population. In this post I provide...

Why Good Economics Matters Now More Than Ever

In a newsletter published in 1970, economist Murray Rothbard wrote, “It is no crime to be ignorant of economics, which is, after all, a specialized discipline and one that most people consider to be a ‘dismal science.’ But it is totally irresponsible to have a loud and vociferous opinion on economic subjects while remaining in this state of ignorance.” This is an oft-quoted platitude within circles of libertarian philosophy and Austrian economics. Today, we are seeing the embodiment of Rothbard’s fears. The woeful state of economic understanding has reached a critical mass. Economics has...

Sessions Pulling Trump Toward Social Conservatism

There once was a time when Donald Trump looked like he was going to be the presidential candidate to finally move the Republican Party away from senseless obsessions over culture war issues. He seldom discussed LGBT issues or the drug war on the campaign trail; his campaign message was almost entirely protectionist economics and building a border wall. Then along came Jeff Sessions. Trump won the GOP nomination as a very moderate candidate, socially speaking. He said Caitlyn Jenner could use whatever bathroom she wanted in Trump Tower, he said he was “fine” with same-sex marriage and paid...

Liz Cheney Wants to Make Torture Great Again

She's back in Washington, and she's eager to pick up where her dad left off. When Liz Cheney returned to her ancestral home state of Wyoming in 2012, she expected to be greeted as a liberator. She moved into a house in Jackson Hole, not far from her parents, Dick and Lynne; she bought a horse for her 13-year-old daughter; and she began laying the foundation for a Senate run. But in the rush to jump-start her political career, Cheney neglected to inform the man she was angling to replace—Mike Enzi, her father's fly-fishing buddy and the state's senior senator. Enzi had been planning to...

Love, Marriage, and the State

Public Practice, Private Law: An Essay on Love, Marriage, and the State, Gary Chartier, Cambridge University Press, 264 pages. This book is about the proper relationship between marriage and state—and yet it’s so much more: an exhaustively researched work on all aspects of love and marriage. So it would be sad if readers uninterested in its political theme passed up the book. Here I will focus the link between marriage and state, but don’t take that to mean that Chartier’s larger purpose is unimportant or uninteresting. His marriage ideal has in my view everything to recommend it, if our...

Substantive Due Process
